These Terms and Conditions constitute a legally binding agreement between you and Kallos Treks concerning your use of our services, including curated travel packages, bespoke itinerary planning, adventure travel, luxury vacations, group tours, corporate travel management, flight and accommodation bookings, travel insurance, and visa assistance. By utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. Services Provided
Kallos Treks offers a comprehensive range of travel-related services. While we strive to provide accurate and up-to-date information, we act as an agent for various third-party suppliers (e.g., airlines, hotels, tour operators, insurance providers). Your contracts for these services are with the relevant third-party suppliers, and their terms and conditions will apply. We are not responsible for the acts, omissions, or failures of these third-party suppliers.
3. Bookings and Payments
- Pricing: All prices are subject to change without notice until a booking is confirmed and full payment is received. Prices are typically quoted in local currency unless otherwise specified.
- Deposits and Final Payments: Specific deposit requirements and final payment due dates will be communicated at the time of booking. Failure to make payments by the due date may result in cancellation of your booking.
- Payment Methods: We accept various payment methods as communicated during the booking process.
4. Cancellations and Refunds
- Client Cancellations: Cancellation requests must be made in writing. Cancellation fees will apply and vary depending on the specific package, supplier terms, and the proximity of the cancellation to the departure date.
- Kallos Treks/Supplier Cancellations: In rare circumstances, Kallos Treks or our suppliers may need to cancel a trip due to unforeseen events. In such cases, we will offer alternative arrangements or a refund, as per the supplier's terms and conditions. We are not responsible for any incidental expenses or consequential losses incurred as a result of such cancellations.
5. Travel Documents and Requirements
It is your sole responsibility to ensure that you have all necessary passports, visas, health certificates, and other travel documents for your entire itinerary. Kallos Treks can provide assistance and guidance regarding these requirements, but we do not guarantee entry into any country, nor are we responsible for any delays or denial of entry due to insufficient or incorrect documentation.
6. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance at the time of booking. Travel insurance should cover cancellation, medical emergencies, personal liability, loss of luggage, and other unforeseen events. Kallos Treks can assist in arranging suitable travel insurance.
7. Limitation of Liability
Kallos Treks, its employees, agents, and affiliates, shall not be liable for any injury, damage, loss, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle, or through the acts or defaults of any company or person engaged in conveying the client or in carrying out the arrangements of the tour or in any way in connection therewith. We shall not be liable for any illness, pilferage, labor disputes, mechanical breakdown, government restraints, weather conditions, acts of terrorism, acts of nature, or any other causes beyond our control. Our liability for any claim arising from your use of our services shall be limited to the amount paid by you for the services in question.
8. Indemnification
You agree to indemnify, defend, and hold harmless Kallos Treks, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use our site or services, your violation of these Terms and Conditions, or your violation of any rights of a third party.
9. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes arising from these Terms and Conditions or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.
10. Amendments to Terms
Kallos Treks reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our online platform. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.
